We present an argument-based formalism of contract dispute resolution following a modern view that the court would resolve a contract dispute by enforcing an interpretation of contract that reasonably represents the mutual intention of contract parties. Legal doctrines provide principles, rules and guidelines for the court to objectively arrive at such an interpretation. In this paper, we establish the appropriateness of the formalism by applying it to resolve disputes about performance relief with the legal doctrines of impossibility and frustration of (...) purpose in common laws of contract. Nowadays, the power systems are getting more and more complicated because of the delays introduced by the communication networks. The existence of the delays usually leads to the degradation and/or instability of power system performance. On account of this point, the traditional load frequency control approach for power system sketches a destabilizing impact and an unacceptable system performance. Therefore, this paper proposes a new LFC based on adaptive integral second-order sliding mode control approach for the large-scale power system with communication (...) delays. First, a new linear matrix inequality is derived to ensure the stability of whole power systems using Lyapunov stability theory. Second, an AISOSMC law is designed to ensure the finite time reachability of the system states. To the best of our knowledge, this is the first time the AISOSMC is designed for LFC of the LSPSwCD. In addition, the report of testing results presents that the suggested LFC based on AISOSMC can not only decrease effectively the frequency variation but also make successfully less in mount of power oscillation/fluctuation in tie-line exchange. Purpose This study aims to ascertain the impact of data collecting awareness on perceived information security concerns and information-sharing behavior on social networking sites. Design/methodology/approach Based on communication privacy management theory, the study forecasted the relationship between information-sharing behavior and awareness of data collecting purposes, data collection tactics and perceived security risk using structural equation modeling analysis and one-way ANOVA. The sample size of 521 young social media users in Vietnam, ages 18 to 34, was made up of 26.7% men (...) and 73.3% women. When constructing the questionnaire survey method with lone source respondents, the individual’s unique awareness and experiences with using online social networks (OSNs) were taken into account. Findings The results of the investigation demonstrate a significant relationship between information-sharing and awareness of data collecting, perceptions of information security threats and behavior. Social media users have used OSN privacy settings and paid attention to the sharing restriction because they are concerned about data harvesting. Research limitations/implications This study was conducted among young Vietnamese social media users, reflecting specific characteristics prevalent in the Vietnamese environment, and hence may be invalid in other nations’ circumstances. Practical implications Social media platform providers should improve user connectivity by implementing transparent privacy policies that allow users to choose how their data are used; have clear privacy statements and specific policies governing the use of social media users’ data that respect users’ consent to use their data; and thoroughly communicate how they collect and use user data while promptly detecting any potential vulnerabilities within their systems. Since 2013, Vietnam has implemented a plan to reform the whole education sector. However, there is little understanding on the status of educational research in Vietnam, which may lay the foundation for such plan. Thus, this research aims to analyze the whole picture of educational research from Vietnam, as seen from the Clarivate Web of Science (WOS) database: 215 publications were recorded, ranging from 1991 to 2018. These 215 publications were further analyzed from five perspectives: 1) number of publications by (...) year; 2) research fields and levels of education; 3) top institutions with the highest number of publications; 4) international collaboration; and 5) quality. Some of the most notable results are: 1) the educational sciences in Vietnam have been still under-developed until recently; 2) among different research topics research among educational sciences, some (e.g., Vocational Education and Training or Early Childhood Education) seemed to be overlooked whereas others (e.g., Higher Education and Teaching and Learning) seemed to receive more attention from educational scholars; 3) all the most major education – specialized universities did not appear among the top five institutions with highest number of publications; 4) Australia, Thailand, the USA, New Zealand and China were the countries with the highest number of co-publications with Vietnamese researchers; and 5) The majority of publications belonged to low-ranked journals. Implications would be withdrawn for Vietnamese policymakers, education leaders, educational researchers and teachers in order to adjust their policies and/or action plans; thus, enhancing the performance and impacts of educational research in the future. Over the last few years, automatic facial micro-expression analysis has garnered increasing attention from experts across different disciplines because of its potential applications in various fields such as clinical diagnosis, forensic investigation and security systems. Advances in computer algorithms and video acquisition technology have rendered machine analysis of facial micro-expressions possible today. Although the study of facial micro-expressions is a well-established field in psychology, it is still relatively new from the computational perspective with many interesting problems. In this survey, we (...) present a comprehensive review of state-of-the-art databases and methods for micro-expressions spotting and recognition. Individual stages involved in the automation of these tasks are also described and reviewed at length. Vì thế, nghiên cứu này được thực hiện để tìm hiểu liệu các nguồn thông tin ảnh hưởng đến quyết định đầu tư của nhà đầu tư có ảnh hưởng đến sự sợ hãi của họ khi khủng hoảng xảy ra hay không. Nghiên cứu đã sử dụng phương pháp phân tích Bayesian Mindsponge Framework (BMF) trên bộ dữ liệu từ 1526 nhà đầu tư Trung Quốc và Việt Nam. The research utilized the Bayesian Mindsponge Framework (BMF) analytics on data collected from 1,526 investors in China and Vietnam. The study results indicated that investors prioritizing different types of information when making investment decisions would have different frequency of fear reactions. Specifically, investors who prioritized information from experts or conducted self-analysis when making investment decisions experienced less freezing (an expression of psychological fear) during market downturns. Conversely, those who based their investment decisions on information from acquaintances, friends, and intuition tended to experience freezing more frequently. (shrink)

The term “dao” (道) has been playing the theoretically paradigmatic role in almost all East Asian philosophies, religions, and cultures. The meanings of the term “dao” in the Dao De Jing and other ancient East Asian texts have remained hermeneutically problematic up to this point in time. This article argues that one of the main causes of this hermeneutical problematic is the failure to establish a theoretically formal typology of the “dao.” It further suggests that a hermeneutically disciplined reading of (...) the 76 uses of the term “dao” in the Dao De Jing accomplishes two important goals: (1) it demonstrates that a typological approach may enhance an understanding of the Laoian Dao, and (2) it provides some good data to begin reconstructing such a theoretically formal dao-typology. Despite receiving a great deal of research attention, the effect of corporate philanthropy on shareholder value remains inconclusive. To address this issue, the present paper examines emotionality as an important factor based on which investors infer about the firm’s motive as well as the beneficiary’s worthiness and react accordingly. Consistent with attribution theory, our event study shows that announcements with more emotional expressions are associated with higher cumulative abnormal stock returns and the effect is stronger when investor attention is greater. We further find that the positive interaction effect between emotionality and investor attention is more pronounced for scandal-free firms than for firms with corporate social irresponsibility (CSI). The empirical evidence remains consistent under various robustness tests. The paper concludes with implications for future research and managerial practices. (shrink)

The article presents a methodological update on the lexical profile of informal spoken English with the emphasis on movies, television programs, and soap operas. The study analyzed Mark Davies’s mega-corpora with data containing approximately 625 million words and employed Paul Nation’s comprehensive and up-to-date British National Corpus/Corpus of Contemporary American English wordlists. Data from the analyses showed that viewers would need a vocabulary knowledge at 3,000 and 5,000 words frequency levels to understand 95 and 98% of the words in scripted (...) dialogs, respectively. Soap operas were found to be less lexically demanding compared to TV programs and movies. Findings are expected to fill in the methodological gaps between vocabulary assessment and vocabulary profiling research. (shrink)

The accession and implementation of new generation free trade agreements bring numerous opportunities as well as challenges to Viet Nam, regarding trade, labor and investment. The increasing number of workers abroad puts a pressure on Vietnamese government to support them in new working cultures and environments. The application of chatbot, which has been known to help certain vulnerable groups such as patients, women and migrants could be one of the tools to support Vietnamese migrant workers by providing immediate information, network (...) connection and consultation. Analyzing the results of the qualitative interviews with 11 migrant workers and the group discussion with two sections from three public social media groups and three active informants, the article argues that migrant workers as a vulnerable group who are supposed to be promising users of chatbot due to their great demand and needs, may have a complicated form of trust and expectation in chatbot. Local item dependence is one of the most critical assumption in the Rasch model when it comes to the validity of a test. As the field of vocabulary assessment is calling for more clarity and validity for vocabulary tests, such assumption becomes more important than ever. The article offers a Rasch-based investigation into the issue of LID with the focus on the two popular formats of Vocabulary Levels Tests : multiple-choice and matching. A Listening Vocabulary Levels Test and an Updated (...) Vocabulary Levels Test were given to a single cohort of 311 university students in an English as a Foreign Language context. The analyses of raw score and standardized residuals correlations were conducted. The findings found no relationship between the 4-option, multiple-choice format of the LVLT and item local dependence. However, results from score and standardized residuals correlations analyses showed a strong link between the 3-item-per-cluster, matching format and item local dependence. The study calls for greater attention to the format of future vocabulary tests and support the use of meaning-recall formats in vocabulary testing. (shrink)

It is not uncommon for business institutions to position themselves as stakeholder-caring companies or organizations. However, there is little research on conceptualizing stakeholder-caring as a component of brand image. Through a theoretical lens of brand-consumer interactions, this paper introduces a new construct—stakeholder-caring image—and proposes a model that examines stakeholder-caring’s antecedents (integrity and courtesy) and its consequence (customer satisfaction). The two antecedents—integrity and courtesy—capture intrinsic and extrinsic aspects of brand-consumer interaction practice, respectively, while the consequence (customer satisfaction) is one important behavioral (...) outcome in marketing. The proposed model was tested with Hong Kong customers (n = 296) via a systematic survey. The data were analyzed using LISREL. Several measurement and structural models were constructed to test the proposed hypotheses. The findings reveal that the effect of integrity on customer satisfaction is mediated by a stakeholder-caring image. However, contrary to the conventional wisdom, we surprisingly find that courtesy is not effective to build a stakeholder-caring image. Managerially, this research offers guidance on how to develop stakeholder-caring image and subsequently increase customer satisfaction. In addition, we discuss the nuanced distinction between a stakeholder-caring image and related brand constructs, such as “sincerity” in Aaker’s (1997) brand personality framework. (shrink)

Anterior cingulate cortex (ACC) is a part of the brain's limbic system. Classically, this region has been related to affect, on the basis of lesion studies in humans and in animals. In the late 1980s, neuroimaging research indicated that ACC was active in many studies of cognition. The findings from EEG studies of a focal area of negativity in scalp electrodes following an error response led to the idea that ACC might be the brain's error detection and correction device. In (...) this article, these various findings are reviewed in relation to the idea that ACC is a part of a circuit involved in a form of attention that serves to regulate both cognitive and emotional processing. Neuroimaging studies showing that separate areas of ACC are involved in cognition and emotion are discussed and related to results showing that the error negativity is influenced by affect and motivation. In addition, the development of the emotional and cognitive roles of ACC are discussed, and how the success of this regulation in controlling responses might be correlated with cingulate size. Finally, some theories are considered about how the different subdivisions of ACC might interact with other cortical structures as a part of the circuits involved in the regulation of mental and emotional activity. What am I? There are a number of possible answers: I am a person, a mind, a human animal, a soul, part of a human being (e.g., a brain), I do not exist, and even more. Philosophers have been asking this for thousands of years and were not satisfied. In the contemporary analytic tradition, philosophers are attracted to a naturalistic, scientific ontology hence a materialistic personal ontology that matches the huge success in scientific discoveries. They think that we are material (...) objects. However, their views do not match our intuition about some cases regarding our survival. Also, the possibility of an afterlife is eliminated. In my thesis, I explain the shortcomings of current philosophical theories, and develop a better account. I propose the Conscious Subject View, according to which (1) I am a subject of experience, a mental entity whose essential property is to be conscious, and (2) Subjects have haecceities, a property that makes an object a different object from other objects even if they are qualitatively identical with it. I provide two arguments for the claim that we are essentially subjects. The first is the Essentiality Argument. I first define an egoistic concern as one such that necessarily, my concern about X can be egoistic if and only if I exist and persist as X. Furthermore, I argue that necessarily, I can be egoistically concerned with an entity E if and only if E is numerically identical with my subject of experience. I then conclude that we are essentially subjects of experience. My second argument, which I call the Argument of Persistence, is that we have the intuition that we persist only when there is the gradual replacement of the brain. I argue that the best candidate to explain this intuition is that we persist as subjects of experience. I further offer a conceivability argument for the claim that haecceity of the subject determines its persistence. I defend a mentally-oriented proposal regarding our nature by examining the essential properties of our existence. It solves most of the problems with the materialistic personal ontology and shows the theoretical advantages of a long-neglected approach. (shrink)

To create a programming environment for contract dispute resolution, we propose an extension of assumption-based argumentation into modular assumption-based argumentation in which different modules of argumentation representing different knowledge bases for reasoning about beliefs and facts and for representation and reasoning with the legal doctrines could be built and assembled together. A distinct novel feature of modular argumentation in compare with other modular logic-based systems like Prolog is that it allows references to different semantics in the same module at the (...) same time, a feature critically important for application of argumentation in legal domains like contract dispute resolution where the outcomes of court cases often depend on whether credulous or skeptical modes of reasoning were applied by the contract parties. ' Home ' and 'nature' are usually taken as two opposite concepts in relation to human geographical experience. However, drawing on the perspective of geo-phenomenology, this paper argues that the meanings of nature and home overlap to the extent that it is possible to experience nature as home. Moreover, it can be shown from the paradoxically interwoven senses of nature and of home that there is a dynamic process of a to and fro journey between nature and home. Fertile educational (...) implications can be drawn out from the invisible journey: first, the dynamic experience between nature and home elicits a learning about differences; and secondly, the experience of nature as home, which can inspire feelings for nature, implies an ethical dimension of learning to treat nature as carefully as home. Insanity is identified with irrationality, while rationality is considered to be the mark of sanity. Yet we want to say that rationality could be the cause of insanity. We can see a subtle kind of insanity inherent in an institution believed to be highly rational. Rationality in an ideological belief also turns into rational insanity when the ideology itself works for the interest of the advantaged as a tool of deception. We believe in the rationality of open communication. We believe (...) that information technology has given us the most rational means for open communication. The Internet revolution or Internet democracy is expected to become the most rational means for the institutional goal of democracy. However the rationality of Internet communication has demonstrated a serious tendency to cause Internet insanity. We have been proud of being 'rational animals'. But now we are concerned because 'rational animal' could mean 'rational but animal-like' or 'rational but impulsive', which in turn could mean 'rational but violent' or 'rational but mad and insane'. Perhaps it is time for us to think seriously about the possibility of mass insanity through rational insanity, and seek the way beyond such rational insanity. (shrink)

The explanatory power of structures in analytical sociologists’ agent-based models brings into question methodological individualism. We defend that from an explanatory point of view, the syntactic properties of models require semantic conditions of interpretation drawn from a conceptual research framework; in such a framework, social/relational structures have only partial, explanatory power ; and taking the explanation further through generative mechanism modeling necessitates calling upon methodological individualism’s generic framework of interpretation that relies on social actors’ rational capacity. Background: This study examined the cyberbullying experience and coping manners of adolescents in urban Vietnam and explored the mediating effect of different support to the associations between cyberbullying and mental health issues.Methods: A cross-sectional study was performed on 484 students at four secondary schools. Cyberbullying experience, coping strategies, psychological problems, and family, peer, and teacher support were obtained. Structural equation modeling was utilized to determine the mediating effects of different support on associations between cyberbullying and psychological problems.Results: There were 11.6 (...) and 28.3% of students who reported that they experienced and observed at least one cyberbullying act in the last 3 months, respectively. Among the victims, only 48.2% tried to stop the perpetrators. Meanwhile, the majority of observers belonged to the “Intervene” group who tried to report cyberbullying acts or help victims. Family support was found to partially mediate associations between cyberbullying experience and observation with levels of psychological problems among adolescents.Conclusion: The 3-month rate of cyberbullying experience and observation among urban adolescents aged 11–14 was low. However, current coping strategies against cyberbullying were not sufficient. Family support is an important factor that should be considered for designing interventions to mitigating the impacts of cyberbullying on the mental health of adolescents. (shrink)

The present study analyzed the vocabulary profile of the News on the Web corpus, which contained 12 billion words from online newspapers and magazines in 20 countries to determine the vocabulary knowledge needed to reasonably understand online newspaper and magazine articles. The results showed that, in general, knowledge of the most frequent 4,000 word families in the British National Corpus/Corpus of Contemporary American English wordlist plus proper nouns, marginal words, transparent compounds and acronyms was necessary to gain 95% coverage for (...) the NOW corpus. However, when it came to the 98% coverage, online newspaper and magazine articles from different countries had relatively distinct lexical demands. In-depth analyses were carried out and the findings offered comprehensive insights into the issue. Implications for teaching and learning were also provided. (shrink)

We provide a logical analysis of private international law, a rather esoteric, but increasingly important, domain of the law. Private international law addresses overlaps and conflicts between legal systems by distributing cases between the authorities of such systems (jurisdiction) and establishing what rules these authorities have to apply to each case (choice of law). A formal model of the resulting interactions between legal systems is proposed based on modular argumentation. It is argued that this model may also be useful for (...) governing the interactions between heterogeneous agents, belonging to different and differently regulated virtual societies, without recourse to a central regulatory agency. The model also provides for multiple interpretations concerning rules of private international law as well as substantive rules of the different legal systems. (shrink)

Samuel Phillips Huntington was an influential American political scientist. He was also a consultant to various America government agencies. He upholds the idea of conservative realism in politics. His research covers several areas of political science, such as civil-military relations, modernization and political development, comparative politics, and international relations. Regarding the role of military, he argues for autonomous military professionalism. In discussing about modernization of developing countries, he emphasizes the priority of political order over democracy. In the case of America, (...) as well as other democratizing countries, he worries that the excess of political participation would diminish the authority and effectiveness of state governance, enhancing political instability, and, at worst, leading to the reverse of democratization. After the end of the Cold War, Huntington characterizes the international order as multicivilizational, in which the clash of civilizations will direct the development of global politics. In such a multicultural situation, Huntington urges Americans to affirm their unique national identity by revitalizing Anglo-Protestant culture and its religiosity which has defined America since its founding.
